MO Supreme Court Overrules Stay of Execution

The Missouri Supreme Court has overruled a death row inmate’s motion to continue a stay of execution, clearing the way for John Middleton’s sentence to be carried out.

In its ruling, the Court also denied Middleton’s motion for a writ of habeas corpus, based on the belief that he was incompetent, and his execution would violate the 8th Amendment.  

On Tuesday in St. Louis, U.S. District Judge Catherine Perry delayed the execution two separate times. The second delay came just two hours before Middleton was to be executed at 12:01 Wednesday morning. 

Perry ruled that the court must first decide if the prisoner is competent. Missouri Attorney General Chris Koster then appealed to the 8th Circuit Court of Appeals. They had previously supported the execution.   

Middleton was put on death row in 1995 after being convicted of murdering three people in Northwest Missouri, because he feared they would go to police about his methamphetamine dealing. 

The state is now free to carry out its’ 6th execution of 2014. It’s not immediately known when that will happen.
